Domestic Terrorism: Further Actions Needed to Strengthen FBI and DHS Collaboration to Counter Threats

The Director of the FBI should, in collaboration with the DHS Under Secretary for Intelligence and Analysis, assess existing formal agreements to determine if they fully articulate a joint process for working together to counter domestic terrorism threats and sharing relevant domestic terrorism-related information and update and revise accordingly. (Recommendation 5)
Open – Partially Addressed
As of March 2024, FBI has formed an internal working group to assess its existing agreements with DHS to counter domestic terrorism threats and share information. To fully implement this recommendation, FBI will need to complete its internal review and coordinate with DHS to make any needed updates or revisions to existing agreements.

Federal Bureau of Investigation The Director of the FBI should, in coordination with the DHS Undersecretary for Intelligence and Analysis, report domestic terrorism incident data from both agencies in response to the annual update requirement in the NDAA for fiscal year 2020. (Recommendation 1)
Open – Partially Addressed
DHS and FBI have taken actions to report domestic terrorism incident data from both agencies. For example, DHS and FBI collaborated to develop the 2023 Strategic Intelligence Assessment and Data on Domestic Terrorism, and are similarly collaborating on the 2024 report due to be issued by the end of summer 2024. DHS and FBI officials have held discussions on which domestic terrorism incidents to include in the 2024 report and have shared multiple drafts with suggested language and other feedback. To fully implement this recommendation, DHS and FBI will need to report domestic terrorism incident data from both agencies in the upcoming 2024 Strategic Intelligence Assessment and Data on Domestic Terrorism, including the criteria for selecting which incident data to report. We will continue to monitor future reporting efforts to confirm data are reported from both agencies.

Facial Recognition Technology: Federal Law Enforcement Agencies Should Better Assess Privacy and Other Risks

Open – Partially Addressed
In April 2024, FBI officials told us the agency has multiple processes to assess the risks of the facial recognition technology it uses, including non-federal systems. The FBI further said it has completed and continues to complete these processes for its use of non-federal FRT as such systems and use cases arise. However, our September 2023 report (GAO-23-105607) found that the FBI did not always complete these processes for the non-federal systems it uses. For instance, the FBI completed a Privacy Threshold Analysis for the use of a facial recognition service by one of its divisions. However, we found the FBI did not complete a PTA for a different service that it used. Until the FBI provides evidence that it has assessed the risks for the non-federal systems it uses, we will consider this recommendation as partially addressed. As of August 2024, this recommendation remains partially addressed.
