Grunley Construction Company, Inc., appeals the final decision of the contracting officer of the Architect of the Capitol (AOC) under contract No. AOC-0400062, denying Grunley's request for an equitable adjustment of $3,640,520 for work performed to replace certain windows at the United States Supreme Court (USSC). Grunley asserts that it and its window subcontractor, Masonry Arts, Inc. (MAI), had to perform additional work to correct AOC's allegedly defective window design. Grunley also contends that AOC is liable for window design changes, differing site conditions, and various other issues relating to the windows' fit, finish, and demolition.
